• Agreement Overview •

This agreement contains the entire understanding between Lindsey Ross Photography (LRP) and the Client listed above. It supersedes all prior and simultaneous agreements between the parties. The only way to add or change this agreement is to do so in writing, signed by all parties. If the Client wants to waive one provision of this agreement that does not mean that any other provision will also be waived. The party against whom a waiver is sought to be effective must have signed a waiver in writing.

• All Inclusive Session Details •

Investment

The Client agrees to the all-inclusive non-refundable investment cost detailed within LRP’s Packages.

The full Session investment cost is due at the time of booking a specific date. The Client will submit payment via PayPal or by Major Credit Card unless other arrangements have been made. 

Rescheduling/Cancelation Policy: The Client may reschedule and/or cancel her Session and apply the investment costs to another Session within a year of the original booking date. Cancellations must be received by LRP at least 48 hours prior to the Session date in order to retain the ability to reschedule. However, should the need arise to reschedule and/or cancel a second time the investment costs will be forfeited.

The Client may transfer the Session to another individual should the need arise. However, the Client agrees to contact LRP to receive further instructions on how to transfer the Session. 

Inclusive Session Details: $777

30 minute “break that ice” & plot session

• 3 outfit changes

• 2 hour session (in studio or on location)

• 20+ fully edited images in a password protected gallery

Upgrade Session. Details: $444

 • UPGRADE your 5x7 album with a faux leather 8x10 album of all your final images

• Professional Hair + Makeup

*Upgrade prices are subject to change at any time. LRP only guarantees upgrade pricing for 30 days post Session date. 

The Session will be held at a location chosen and an additional fee may be assessed for use of a location and that will be disclosed to the Client prior to booking. 

The Client understands that additional props such as vintage cars and/or locations may be an additional fee that is required at the time of booking and are also non refundable.

The LRP “Welcome Packet”

The Client understands that before the investment cost has been received the Client will receive a “Welcome Packet” via email including the following:

The Client understands that once the investment cost has been received the Client will receive the following to help plan their Session:

Military and Veterans with valid ID are eligible to receive 10% off the Session Fee with the “Hometown Hero Discount”. This discount does not apply to Upgrades and/or additional products purchased.

Editing & Client Gallery

The Client understands that 20+ Final Images will be selected by LRP from their Session for expert retouching and airbrushing. The Client understands that once these images are selected any/all Proof Images will be permanently deleted. 

A, one image, “Sneak Peek” will be made available in the Client’s personal gallery within 10 days of the Session. The Client will receive a private password protected gallery at www.lindseyrossphotography.com. Gallery notifications will be sent to the email address provided by the Client. 

All Galleries will be completed and posted no later than 14 days after the Session date. Galleries will only be available for 14 days for download. A fee of $25 will be billed for each additional week requested.

The Client understands that she will be responsible for choosing the Images for download and any selections for albums or prints included in the package chosen, via the form sent within the Gallery Notification Email, within 14 days of their images being uploaded to the Gallery. If this deadline is not met LRP cannot guarantee a delivery time and/or an additional $25 fee may be applied for reposting Galleries. The Client understands that if she fails to submit the selections with 30 days she may forfeit the products included within her package and/or incur a hourly rate of $20 for archival and redesigning.

The Client understands that a rush fee of $50 will be applied for all overnighted orders. 

Photographs, digital negatives, and prints by LRP are under the protection of Federal Copyright Law (all rights reserved) and legally belong to Lindsey Ross Photography (LRP). LRP retains the copyright to all photographs and images produced. Personalized CDs with reproduction rights are for PERSONAL USE ONLY including and limited to: sharing with friends and relatives; posting on social networking sites; reprinting for personal use. The Client must obtain written permission from Lindsey Ross Photography prior to the Client publishing or selling the photographs for profit.

Client Cooperation

The Client agrees to cheerful cooperation and communication for the best possible result before and during the session. LRP is not responsible if the Client fails to appear and/or fails to cooperate during the session(s) or for missed images due to details not revealed prior to the Session. The Client agrees that should they are late for the Session that this could have an effect on the number of final images and accepts responsibility for those missing images. 

Events: Due to the booking schedule the Client agrees to arrive no more than 5 minutes before or after their scheduled session time. If the Client appears later than 10 minutes after the scheduled session time the Client will forfeit their session. Rescheduling will not be permitted and no refunds will be issued. 

Limit of Liability

In the unlikely event of severe medical, natural, or other emergency it could be necessary to retain a different Photographer and/or Makeup Artist/Hair Stylist. LRP will make every effort to secure a skilled replacement should this occur. If a suitable replacement is not found, responsibility and liability is limited to the return of all payments received from the Client. LRP takes the utmost care with the respect to exposure, transportation, and processing of the photographs, including using professional grade equipment and professional grade backup equipment. However, in the unlikely event those photographs have been lost, stolen, or destroyed for reasons within or beyond LRP’s control, LRP’s liability is limited to the return of all payments received for the Session package. The limit of liability for a partial loss of originals shall be a prorated amount of the exposures lost based on the percentage of total number or originals and/or free products.

Personal Limit of Liability

The Client understands that sessions may expose them to natural dangers and releases LRP from any and all liability. Such dangers include poisonous plant exposure and/or animal or insect bites. The Client agrees to wave any owners of properties and/or props used from liability for any and all injuries. The Client also agrees to provide restitution for damage that occurs during the use of properties and/or props that was caused by the Client. The Client also understands and agrees to not hold LRP responsible if a bodily injury occurs due to location choice or pose chosen.
